Terms of Service

These Terms of Service ("Terms") govern your access to and use of Taskwizid ("Taskwizid," "we," "us," or "our"), including our website, application, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms.

1. Who We Are

Taskwizid is operated by Louis Andrade, a sole proprietorship based in Massachusetts, USA ("we," "us"). You can reach us at support@taskwizid.com.

2. The Service

Taskwizid provides AI-powered "employees" that help small businesses automate tasks such as email handling, phone reception, customer support, scheduling, and related business operations ("Service"). Features, agents, and pricing may change over time as described in Section 7.

3. Accounts

• You must provide accurate information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 18 years old and authorized to bind your business to these Terms.
• One account is intended for one business ("Company"). You may invite team members subject to your plan's terms.

4. Free Trial

We may offer a free trial period. At the end of the trial, you will be required to select a paid plan to continue using the Service, as described at signup. We reserve the right to modify or discontinue trial offers at any time.

5. Subscriptions and Billing

• Paid plans are billed monthly in advance via our payment processor, Stripe.
• Prices for each tier are shown on our Pricing page and may change with notice; changes will not apply to your then-current billing cycle without your consent, except as described below.
• Fair-use overage: Certain features (e.g., phone minutes) include a fair-use allotment per tier. Usage beyond that allotment is billed at the rate disclosed on our Pricing page. Overage billing does not result in service interruption.
• Existing customers: Once you subscribe, your price is locked in for that plan; future price changes apply only to new signups unless you change plans yourself.
• All fees are exclusive of applicable taxes, which will be calculated and added at checkout.
• Failure to pay may result in suspension of Service after reasonable notice.

6. Cancellation

You may cancel your subscription at any time through your account's billing portal. Cancellation takes effect at the end of your current billing period, and you will retain access until that date. We do not provide refunds for partial billing periods except where required by law.

7. Changes to the Service

We may add, modify, or remove features of the Service at any time. We will make reasonable efforts to notify you of material changes that affect your use of the Service.

8. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law
• Attempt to gain unauthorized access to the Service or other users' data
• Use the Service to send spam, harassing communications, or fraudulent content
• Reverse-engineer, decompile, or attempt to extract the source code of the Service
• Use the Service in a way that could disable, overburden, or impair it

We reserve the right to suspend or terminate accounts that violate this section.

9. AI-Generated Content

Taskwizid's AI employees generate drafts, suggestions, and, in some cases, take actions on your behalf (e.g., sending emails, answering calls) based on settings you configure. You are responsible for reviewing AI-generated content before it is sent where our approval workflow provides that option, and for the business decisions you make using the Service. Taskwizid does not guarantee the accuracy of AI-generated content.

10. Your Data

• You retain ownership of the business data you upload or connect to Taskwizid (e.g., via Gmail, Calendar, or other integrations).
• We use your data solely to provide and improve the Service, as described in our Privacy Policy.
• You are responsible for ensuring you have the right to share any third-party data (e.g., customer contact information) with Taskwizid.

11. Third-Party Services

Taskwizid integrates with third-party services, including Google (Gmail, Calendar, Tasks, Drive), Twilio, ElevenLabs, Anthropic, and Stripe. Your use of these integrations is also subject to those providers' own terms and privacy policies.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED OUTPUTS WILL BE ACCURATE OR SUITABLE FOR YOUR PURPOSES.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TASKWIZID SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

14. Termination

We may suspend or terminate your access to the Service if you violate these Terms or fail to pay applicable fees. You may stop using the Service and cancel your account at any time.

15. Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
